These Terms govern your use of Bonsai Tracker (the "Service"), provided by Forgione USA, Inc. ("we", "us"). By creating an account or using the Service you agree to these Terms.
You agree not to misuse the Service, including: unlawful use, fraud, spam, intellectual property infringement, distributing malware, scraping, or interfering with security or operation. You are responsible for activity under your account and for keeping credentials confidential. You must provide accurate information.
We retain ownership of the Service, our software, branding, and documentation. You grant us a limited, non-exclusive license to host and process your content solely so we can provide the Service. You retain ownership of your tree photos, notes, and other content you upload.
The Service includes AI-generated suggestions for bonsai care. AI outputs may be inaccurate or incomplete and are provided for general guidance only — they are not a substitute for professional horticultural, veterinary, or other expert advice. You are responsible for your prompts and any decisions you make based on outputs. Do not use AI features to generate unlawful content, infringe third-party rights, or attempt to circumvent safety filters.
Payments are processed by Stripe. Payment, billing, tax, cancellation and refund mechanics are governed by our Refund Policy. Stripe's processing is subject to Stripe's Terms.
Subscriptions renew automatically at the end of each billing period until canceled. Lifetime purchases are one-time and grant permanent access to the corresponding tier under these Terms.
We do not guarantee that the Service will be uninterrupted, error-free, or available at all times. To the fullest extent permitted by law, we disclaim all implied warranties including merchantability and fitness for a particular purpose.
We may suspend or terminate your access for material breach of these Terms, non-payment, security or fraud risk, or repeated or serious policy violations. On termination you may export your data within a reasonable window before deletion.
To the fullest extent permitted by law, our aggregate liability is limited to the fees you paid us in the 12 months preceding the claim. We are not liable for indirect, consequential, or special damages including loss of profits, data, or goodwill. Nothing in these Terms excludes liability that cannot be excluded by law.
We may update these Terms from time to time. Continued use after changes constitutes acceptance.
